1. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You may not:

• Use the Service for illegal or fraudulent activities
• Interfere with or disrupt the platform
• Attempt to gain unauthorized access to systems or data
• Use automated systems (bots/scrapers) without permission

2. Eligibility

You must be at least 13 years old to use the Service. By creating an account, you represent and warrant that you are 13 years of age or older. If you are under 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms, and any paid subscription must be purchased by that parent or guardian.

We do not knowingly collect information from, or provide the Service to, children under 13. If we learn that a user is under 13, we will terminate the account and delete its data.

2a. Accounts

To use certain features, you must create an account.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

Some features require a paid subscription.

• Prices are listed within the Service
• Payments are processed through third-party providers
• Free trials require a valid payment card. When a free trial ends, your card is automatically charged for the selected plan and your paid subscription begins, unless you cancel before the trial ends
• Subscriptions renew automatically each billing period unless canceled. You can cancel at any time from your account Settings page; cancellation takes effect at the end of the current billing period
• All payments are non-refundable — see our Refund Policy for full details

We may change pricing at any time with notice.

4. User Content

You retain ownership of any content you upload (images, listings, etc.).

By uploading content, you grant us a limited license to:

• Use, process, and display content to provide the Service
• Generate AI outputs based on your content

You are responsible for ensuring your content:

• Does not violate any laws
• Does not infringe on intellectual property rights

5. AI-Generated Content — Important Limitations

By using the Service, you acknowledge and agree that:

• AI outputs are estimates only. Price suggestions and demand scores are not guarantees of sale price, market value, or buyer interest. Actual results depend on many factors outside our control, including market conditions, item condition, platform fees, and buyer demand.
• You are responsible for reviewing all AI-generated content before posting or acting on it. Do not publish a listing without first checking that the title, description, price, condition grade, and any other details are accurate for your specific item.
• AI can misidentify items. The AI may incorrectly identify a brand, model, condition, or category. Always verify the AI's output against the actual item in front of you.
• AI-generated descriptions may contain errors. Information about materials, specifications, or features may be wrong. You are solely responsible for the accuracy of any listing you post based on our output.
• We are not liable for losses arising from AI errors. If you price, list, or sell an item based on AI-generated content that turns out to be inaccurate, Pic2Sell bears no responsibility for any resulting financial loss, dispute, or claim.

Use Pic2Sell as a starting point and productivity tool — not as a substitute for your own judgment. The final check is always yours.

6. Third-Party Services

The Service may reference or link to third-party platforms and services.

We are not responsible for:

• Actions, policies, or fees of any third-party platform
• Changes to their APIs, rules, or functionality

Your use of third-party services is subject to their own terms.

7. Prohibited Activities

You may not:

• Upload misleading or false product information
• Upload photos that prominently feature identifiable people — especially children — rather than the item being sold. Photos you upload are processed by third-party AI providers; only photograph the item itself.
• Upload content you do not have the right to use or share
• Manipulate pricing or marketplace data unfairly
• Engage in spam, abuse, or deceptive practices
• Attempt to exploit platform vulnerabilities

8. Termination

We may suspend or terminate your access at any time if:

• You violate these Terms
• Your activity poses risk to the platform or users

You may stop using the Service at any time.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available."

We make no warranties regarding:

• Reliability or availability
• Accuracy of data or AI outputs
• Financial outcomes or profits

10. Limitation of Liability

To the fullest extent permitted by law, Pic2Sell shall not be liable for:

• Loss of profits or revenue
• Data loss
• Indirect or consequential damages

Your use of the Service is at your own risk.

11. Indemnification

You agree to defend and hold harmless Pic2Sell from any claims, damages, or liabilities resulting from:

• Your use of the Service
• Your violation of these Terms
• Your content or activities

12. Changes to Terms

We may update these Terms at any time. Continued use of the Service means you accept the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.
